Terms of Service
Effective date: June 13, 2026. These Terms of Service govern your access to and use of banana-goat.com, the BANANA-GOAT platform, and related services provided by Wallnah, trading as BANANA-GOAT.
Who we are and acceptance of these terms
BANANA-GOAT is operated by Wallnah, trading as BANANA-GOAT, located at Piet Heinstraat 12, 7511 JE Enschede, Netherlands. By accessing or using BANANA-GOAT, you agree to these Terms of Service and our related policies, including our Privacy Policy and Cookie Policy.
If you are using BANANA-GOAT on behalf of a company or other organization, you represent that you have authority to bind that organization to these terms, and in that case the words 'you' and 'your' refer to that organization.
Eligibility and accounts
You must be at least 16 years old and able to enter into a binding agreement to use BANANA-GOAT. The service is intended for professional, commercial, and business-related 3D viewing workflows, although individual users may also create accounts where permitted.
You are responsible for maintaining the confidentiality of your account credentials, for all activities that occur under your account, and for ensuring that the information you provide is accurate and kept up to date.
- You must provide accurate account and billing information
- You must keep your login credentials secure
- You are responsible for activity under your account unless caused by our breach
- You must notify us promptly if you believe your account has been compromised
What BANANA-GOAT provides
BANANA-GOAT is a secure 3D viewing service. Customers upload supported source models, BANANA-GOAT processes those models into a viewer-oriented runtime representation, and customers can manage, review, publish, share, embed, or otherwise present that output through BANANA-GOAT workflows.
BANANA-GOAT is not a general-purpose file storage or raw asset distribution service. The service is designed around secure presentation and viewer delivery rather than returning or openly publishing reusable source files.
Customer content and your rights
You retain your rights in the models, files, text, branding, and other content you upload to BANANA-GOAT ('Customer Content'), subject to any rights you grant to us in these terms. You are solely responsible for Customer Content and for ensuring that you have all rights, permissions, and legal authority needed to upload, process, display, share, and publish it through the service.
By using BANANA-GOAT, you grant us a non-exclusive, worldwide, limited license to host, copy, process, transmit, display, modify as technically necessary, and otherwise use Customer Content solely to provide, secure, maintain, improve, and support the service, including creating viewer outputs, hosting links and embeds, preventing abuse, and complying with law.
- You must not upload content you do not have the right to use
- You are responsible for obtaining required permissions, licenses, consents, and notices
- You remain responsible for the legality of Customer Content and how it is published through your account
Source processing and viewer outputs
As part of the service, BANANA-GOAT may process uploaded source files into runtime viewer outputs that are stored in your account library and used for in-app viewing, share links, embeds, and related presentation workflows. Viewer outputs are part of the service experience and may differ materially from the original uploaded source file.
BANANA-GOAT is intended to remove the original source file from the normal public delivery flow after processing, but you acknowledge that no system can guarantee absolute protection against copying, capture, or reverse engineering of delivered viewer experiences.
Acceptable use
You may not use BANANA-GOAT in a way that is unlawful, abusive, deceptive, harmful to others, harmful to the service, or inconsistent with the intended purpose of the platform.
We may investigate misuse and take action, including limiting functionality, suspending links, suspending accounts, removing content, or terminating access.
- Uploading unlawful, infringing, fraudulent, defamatory, or malicious content
- Attempting to bypass plan limits, security controls, access restrictions, or viewer protections
- Interfering with the service, infrastructure, or other users
- Using BANANA-GOAT to distribute malware, harmful code, or abusive traffic
- Scraping, harvesting, probing, or reverse engineering the service itself except as permitted by applicable law
- Using share links or embeds in a misleading, deceptive, or unauthorized way
- Attempting to access accounts, models, or data that you do not have permission to access
Plans, subscriptions, and billing
BANANA-GOAT may offer free plans, paid self-serve plans, and custom or enterprise plans. Features, usage limits, storage allowances, upload limits, showing allowances, share allowances, embed allowances, API access, support levels, and pricing may vary by plan.
Paid plans renew on the billing cycle presented at the time of purchase unless otherwise stated. Payments may be processed through Stripe or another payment provider we designate. You authorize us and our payment providers to charge the applicable fees, taxes, overages, renewals, and other agreed charges using your selected payment method.
Self-serve plan prices are listed in US dollars and exclude tax. Applicable VAT or sales tax is calculated and added at checkout based on your billing address.
Your first paid charge on a self-serve plan may be refunded in full within 14 days of that first charge. After that window, cancellations take effect at the end of the current billing period and you keep access until then. Later renewals do not open a new 14-day refund window. Switching between Individual and Pro is prorated for unused time in the current period.
- Fees are generally billed in advance for subscription periods unless otherwise agreed
- Taxes, duties, and similar charges are added at checkout unless the law requires otherwise
- If payment fails, we may retry charges and freeze uploads, share links, and embeds until payment succeeds
- Except for the 14-day first-charge refund and where required by law, fees are otherwise non-refundable
Enterprise and usage-based pricing
Enterprise or custom customers may have separate order forms, statements of work, pricing schedules, or negotiated commercial terms that supplement these terms. Those commercial terms may include custom limits, service commitments, support levels, invoicing terms, minimum commitments, and usage-based pricing.
Where enterprise pricing includes metered or usage-based components, such as storage, traffic, public viewing, processing volume, or other service metrics, those charges may be billed through Stripe, invoicing, or another agreed billing method. If there is a conflict between these terms and a signed enterprise agreement, the signed enterprise agreement will control for that customer.
Links, embeds, and viewer access
BANANA-GOAT may allow publishers to create share links, embeds, and related viewer delivery methods. Viewers may be able to open shared or embedded experiences without creating a BANANA-GOAT account, but those viewers receive only the access that the publisher and the service configuration allow.
You are responsible for how you distribute links and embeds. BANANA-GOAT may limit, revoke, expire, disable, or otherwise control links, embeds, or viewer access where required by plan limits, security needs, abuse prevention, legal obligations, customer settings, or product rules.
Our intellectual property
BANANA-GOAT, the software, platform design, workflows, branding, documentation, site content, and related technology are owned by Wallnah or its licensors and are protected by intellectual property and other laws.
Except for the limited rights expressly granted to you in these terms, we reserve all rights, title, and interest in and to BANANA-GOAT and our technology. These terms do not transfer ownership of BANANA-GOAT or any of our intellectual property to you.
Suspension, termination, and account closure
You may stop using BANANA-GOAT at any time. Deleting your account wipes stored models and related account data and stops paid billing immediately. If you are still inside the 14-day first-charge refund window, that first paid charge is refunded. We may also suspend or terminate your access, freeze uploads, links, and embeds, or limit service functionality if we reasonably believe that you have violated these terms, failed to pay required fees, created legal or security risk, or used the service in a way that could harm BANANA-GOAT, other users, or third parties.
Upon termination or account closure, your right to use the service ends. We may delete or deprovision Customer Content, runtime outputs, account information, links, and related materials in accordance with our policies, technical processes, legal obligations, and retention practices.
Disclaimers
BANANA-GOAT is provided on an 'as is' and 'as available' basis except to the extent otherwise expressly stated in a signed agreement. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that the service will be uninterrupted, error-free, or completely secure.
We do not warrant that BANANA-GOAT will meet every customer's needs, that all models or file types will always process successfully, or that viewer outputs will be immune from copying, capture, scraping, or reverse engineering.
Limitation of liability
To the maximum extent permitted by law, Wallnah, BANANA-GOAT, and our affiliates, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, business opportunity, use, data, or content, even if we have been advised of the possibility of those damages.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to BANANA-GOAT and these terms will not exceed the greater of the amount you paid us for the service during the 12 months before the event giving rise to the claim or 100 EUR. Nothing in these terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Wallnah, BANANA-GOAT, and our affiliates, officers, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising out of or related to your Customer Content, your use of the service, your violation of these terms, or your violation of applicable law or third-party rights.
This section does not require you to indemnify us for claims caused solely by our own breach of these terms or our own unlawful conduct.
Changes to the service and these terms
We may change, update, suspend, or discontinue parts of BANANA-GOAT from time to time, including features, plans, usage limits, workflows, security measures, or integrations. We may also update these terms to reflect changes in the service, law, or business operations.
When we make material changes to these terms, we will post the updated version on this page and update the effective date or provide other notice as appropriate. Your continued use of BANANA-GOAT after the updated terms become effective means you accept the updated terms.
Governing law and contact
These terms are governed by the laws of the Netherlands, excluding conflict-of-law rules, unless mandatory law in your jurisdiction requires otherwise. The competent courts of the Netherlands will have exclusive jurisdiction over disputes arising out of or relating to these terms or the service, except where applicable law provides otherwise.
